Most EU projects are obliged to have a consortium agreement to define the internal functioning of the consortium, i.e. governance, IPR, confidentiality etc. This general obligation also applies for Horizon Europe projects.
In Horizon 2020, the vast majority of projects made use of the DESCA Model Consortium agreement (CA).DESCA (Development of a Simplified Consortium Agreement) is a comprehensive Model Consortium Agreement for EU research projects. Initiated by key stakeholders for the 7th EU Framework Programme and updated for Horizon 2020 in consultation with the stakeholder community, it offers a reliable frame of reference for project consortia.
The work to adapt DESCA to the rules of Horizon Europe is ongoing. The coordinators of the DESCA initiative, Kathrin Werner, Fraunhofer-Gesellschaft, and Annika Thies, Helmholtz Association, will give you an update on the state of play of the work and on the adaptations to be expected.
Annika Thies is the director of the Brussels office of the Helmholtz Association, Germany’s largest research organisation. Her focus lies on European research policy and European research infrastructure strategy. She studied law in Trier, DE and Nancy, FR, and has worked as a legal counsel both for the German Aerospace Centre (DLR) and for the European Commission in the Directorate-General for Research and Innovation. Together with Kathrin Werner Annika coordinates the DESCA model-consortium initiative.
Kathrin Werner is a legal counsel and heads the team Legal Affairs for Public and EU Projects at the headquarters of Fraunhofer-Gesellschaft in Munich. In this position, she is resonsible for legal matters related to nationally and internationally funded research projects, with particular expertise in IPR issues within EU funding programmes. Kathrin studied law in Augsburg (Germany) and Lund (Sweden) and is a member of the Munich Bar Association. She holds an LL.M. of Lund University and is a qualified business mediator (CCI). Together with Annika Thies, Kathrin coordinates the DESCA model consortium agreement initiative.
